what action must be taken after an accident?

David T asked:

My friend got into an accident the night before and i was wondering what action to take and what are the procedure.
-Since it’s the holiday weekend, i’ll wait till tuesday to call the insurance company to report it.
-after i call insurance company, what do they do? do they do research? ask me for picture of the scene? do they contact the other party immediately.
-when do they come to investigate the car and the scene?
-do i have to get a lawyer?
-no one was hurt at that time, how am i sure that they won’t say that they’re injured or something?
thanks a lot

If both parties had car insurance, then you should both report what had happened to the insurance companies, and then the insurance companies take care of it from there.

You should not have to hire a lawyer to do anything unless the person is saying that you did it, and it was really their fault.

If there is denying involved, or a false story from the other person, you should most likely hire a lawyer to defend you in the court of law.

If nobody was injured, the only responsibility of the insurance company is to make sure that you get proper damage coverage and repair to your car.

Hopefully, you exchanged information with the other driver. Call your insurance company and start a claim. They will ask you what happened, who was involved, the extent of the damage, and for the other party’s information. If you want to get your car fixed, they’ll send out someone to give you an estimate. They’ll also contact the other party and ask them what they would like to do. You don’t need a lawyer. It’s all mostly phone calls and paper work.

    1. ask if anyone’s injured.
    2. If car damage, call the police.
    3. Call insurance
    4. If the police were called and a ticket issued get a copy of their report.
    5. If there was a report by Police tell your insurance company about it, and if you got a ticket.
If you got a ticket and don’t tell your insurance company they can drop you.

What you should have done: Call police and report an accident. If at all passable walk to a convince store and buy a disposable camera. If no store available use you cell phone. Most all cells have photo and video now days. Get shots from every angle.(That has saved my but more than once) Then at first opportunity call the insurance co.

Your friend should have called his/her insurance company immediately, to give them the other driver’s address, license plate #, phone number, and insurance company name.

Insurance companies take care of the medical and legal matters. Hopefully there is enough coverage on the insurance policy, in the case that your friend is at fault. If there isn’t enough coverage, then a lawyer may be necessary, if your friend and the other party can’t come up with a settlement.

Within the near future the insurance company will send someone to assess the damages to your friend’s car. The insurance will not investigate the scene, that is what the police do, documenting the scene on written report.

Filing auto accident insurance claims is quite tedious. But to get your compensation for the accident, it is a necessary procedure - so you might as well go about it in the fool-proof manner described here.Uncertainty finds an innate part in human life. Being human being, we are never aware of crisis caused by occurrence like accidentGenerally, the insurance covers mishaps like organ loss like hands, eyes and legs, death in air, rail and car accident. The principal sum paid to a family ranges from $25,000 to $1,00,000. But you are excluded from being paid the amount if accidents persists due to drunken driving and trying risky sports like bungee jumping, car racing, skiing, scuba diving, etc.
