If injured in a rear end auto accident, that is not my fault, who’s insurance do I file an injury claim with?

I was stopped at a red light and a car travelling about 40 rearended me. I was told I would have to file all medical bills with my insurance . Is this correct?

    with yours thats why you pay them. But its not like their loosing out because their ganna go after that other persons insurance

    you need to let your insurance company know because they will go afterthe other party’s insurance and have them pay. better yet, call an abulance chaser attorney and get big money. then you wont have to worry about it. but generaly you let your ins company know about it and the other party’s ins pays.

    Yes it is.. What happens is that you file everything with your insurance company, property and physical. They go ahead and pay for everything, then fight with the other insurance company to get repaid.

    If the other person hit you and they have insurance coverage then their insurance company should pay for it. You need to call their company to file a claim. DO NOT contact your company unless their company denies your claim. If you use your auto insurance company your rates could increase and that could go on your driving record.

    Sounds like you live in a “no fault” state. This means your insurance is primary for injuries. So yes, call them and file a claim. Youll want to make the at fault parties insurance aware as well.

    Your insurance carrier will explain to you how your specific state works and who pays what.

    Nooooooo, you file on the insurance of the person who hit you first. File for medical bills under their policy and after they have paid you all they intend to give you, you THEN file any remaining expenses on your own insurance.

    this just happened to me too so i am going through the same process. I filed with my insurance then found out if I want the person who is responsible for the accidents insurance company to pay for it i have to file it with their insurance. If you file with yours then you are basically telling them that you want your insurance to pay for it, so if you want the other persons insurance to pay for it you have to call their insurance agency and report it with them.
